Two actions in the Clay County District Court against the same defendants, one by Rodney C. Sims for property damage and for
consequential damages for his wife's injuries; and one by said wife, Marilyn Sims, for her personal injuries which resulted
when the automobile in which she was riding, driven by her husband, was struck by an automobile driven by defendant Gary C.
Bennyhoff in such a way that it collided with an automobile owned by defendant Alice Welch, d.b.a. Service Cab Company, at
a place where defendant Hallett Construction Company was engaged in a highway construction project. The cases were tried before
Byron R. Wilson, Judge, and a jury, which returned verdicts of $7,500 and $8,000 for Rodney and Marilyn respectively. A verdict
of dismissal having been granted as to defendant Alice Welch, the verdicts were against the other defendants only. Defendant
Hallett Construction Company appealed from an order in each case denying its alternative motion for judgment or a new trial. AUTHOR: MURPHY
